If you become eligible for a family or medical leave of absence that qualifies under the Family and Medical Leave Act (FMLA), your health plan coverage may be continued on the same basis for up to 12 weeks. You may qualify for FMLA:

  1. To care for your child after the birth or placement of a child with you for adoption or foster care; your leave must be completed within 12 months
  2. To care for your spouse, child, foster child, adopted child, stepchild, or parent who has a serious health condition
  3. For your own serious health condition

If you and your spouse are both covered as members of ASEA/AFSCME Local 52 Health Benefits Trust, the continued coverage to care for a new child or a parent with a serious health condition may not exceed a combined total of 12 weeks.
